Terms of Service

By accessing or using the BetterSchool platform, website, or mobile applications (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and BetterSchool, Inc. ("BetterSchool," "we," "us," or "our").

To use BetterSchool, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Platform under applicable law
• Provide accurate and complete registration information

Minors may use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

Account Creation: You must create an account to use certain features of the Platform. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

Account Termination: We reserve the right to suspend or terminate your account at any time for violations of these Terms or our Community Guidelines, or for any other reason at our sole discretion.

BetterSchool provides a platform that connects families with activity providers, including but not limited to classes, camps, workshops, and other educational experiences (collectively, "Activities").

Platform Role: BetterSchool acts as an intermediary platform. We do not provide, operate, or control the Activities themselves. Activity providers are independent third parties responsible for delivering the Activities.

No Warranties: We make no representations or warranties about the quality, safety, or suitability of any Activities. While we conduct verification and background checks on providers, you acknowledge that participation in Activities is at your own risk.

Booking Fees: When you book an Activity through the Platform, you agree to pay the price listed plus any applicable service fees, taxes, or additional charges.

Payment Processing: All payments are processed securely through our third-party payment processors. You authorize us to charge your selected payment method for all fees.

Service Fees: BetterSchool charges a service fee for facilitating bookings. This fee is disclosed before you complete your booking and is generally non-refundable.

Cancellation Policies: Each Activity has its own cancellation policy set by the provider. You can view the cancellation policy before booking. Refund eligibility depends on when you cancel relative to the Activity start time.

Provider Cancellations: If a provider cancels an Activity, you will receive a full refund including service fees.

Platform Cancellations: We reserve the right to cancel any Activity for safety, security, or policy violation reasons. In such cases, you will receive a full refund.

You agree to comply with our Community Guidelines and applicable laws. Prohibited conduct includes but is not limited to:

• Providing false or misleading information
• Impersonating others or providing false credentials
• Engaging in fraudulent or deceptive practices
• Harassing, threatening, or abusing other users
• Violating intellectual property rights
• Attempting to circumvent payment systems
• Using the Platform for any illegal purpose

AS-IS Basis: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

Activity Participation: You acknowledge that participation in Activities involves inherent risks. BetterSchool is not responsible for any injuries, damages, or losses arising from your participation in Activities.

Maximum Liability: To the maximum extent permitted by law, BetterSchool's total liability to you for any claims arising out of or related to these Terms or the Platform shall not exceed the greater of $100 or the amount of fees you paid to BetterSchool in the twelve months preceding the claim.

Informal Resolution: If you have a dispute with BetterSchool, please contact us first at support@betterschool.com to attempt to resolve the issue informally.

Arbitration Agreement: Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.
